A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.
The case stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to face human smuggling charges, he was held in federal detention.
In her order, the judge noted that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
